In Order to Register and be a bidder at this auction, each bidder must sign and agree to the following registration contract:

Successful Bidder’s Agreement to Indemnify and Hold Harmless, Alaska Auction, Seward Drug Company, the consignor/s and their agents, from any and all Liability arising in the connection with the removal and any use now or in the future for pleasure or profit of herbs, remedies, medicines, stock, chemicals, elixirs, tonics, rubs, Quack Medicines goods, and equipment, from the premises known as Seward Drug Company.

The undersigned bidder, as a term and condition of participating in the October 15, 2005, auction of herbs, remedies, medicines, the stock, chemicals, elixirs, tonics, rubs, Quack Medicines goods, and equipment, from the premises known as Seward Drug Company hold harmless Alaska Auction Company and Seward Drug Company the consignor/s its agents, attorney’s fees and costs, arising out of any loss, damage, or injury to persons or property lot of herbs, remedies, medicines, stock, chemicals, elixirs, tonics, rubs, Quack Medicines goods, and equipment from the premises for any use now or in the future for pleasure or profit of goods.

The Undersigned Bidder Further Acknowledges, Agrees, And Understands That Alaska Auction Company Offers Said herbs, remedies, medicines, stock, chemicals, elixirs, tonics, rubs, Quack Medicines goods, and equipment For Auction Sale Without Warranty On An “As Is”  “Where Is” Basis Seller Is Former Dealer For Manufacturer, Purchaser Is Independently Responsible For Investigating The lethal, toxic, explosive or poisonous effects Seller Makes No Warranty, Representation Or Condition Of Any Type Kind Whatsoever, Any Warranty, Express Or Implied, Is Hereby Excluded And Disclaimed Including The Implied Warranties Of Merchantability And Of Fitness For A Particular Purpose.  All Equipment Is Purchased As Is And With All Faults.

Seward Drug Company is the former owner of some items sold.  Alaska Auction Company and Seward Drug Company, the consignor/s its agents, employees, representatives, and assigns (collectively the “Seller) make no warranty, representation or condition of any kind; and any warranty, express or implied, is hereby excluded and disclaimed including the implied warranties of merchantability and of fitness for a particular purpose.  All equipment is purchased as is and where as with all faults.  Purchaser is independently responsible for investigating the lethal, toxic, explosive or poisonous effects.  Purchaser has also had a full and complete opportunity to inspect the items purchased and has done so to purchaser’s complete satisfaction. 

Purchaser releases and fully discharges seller from any and all liability in tort (including negligence), in strict liability or otherwise and under no circumstances shall seller be liable for any damages of any type whatsoever including but not limited to special, incidental or consequential damages, personal injury, property damage, damage to or loss of equipment, lost profits or revenue, and other additional expenses, even if seller has been advised of the possibility of such damages.  The price Remedy.  Purchaser hereby agrees to indemnify, defend, save and hold harmless Seller harmless from any claims, lawsuits, or liability, including attorney’s fees and such items.  The purchase price is and serves as consideration for limiting Seller’s liability and Purchaser’s remedies as set forth herein.

Terms of the Sale
Seward Drug Company Auction Saturday, October 15, 2005

·        Notice All bidders’ names, address and phone numbers are going to be submitted to all local, state and federal narcotic related officials.

·        Warning All the Items for sale should not be ingested or used in any way.  The values of these items are in the historical significance only.  Items are old are these may be unstable and change the original substance.  Many items are lethal, toxic poisonous, dangerous and cause severe and irreparable damage.

·        In Order to register and be a bidder at this auction, each bidder must sign and agree to the registration contract.

·        We reserve the right to refuse service to anyone.

·        Everything sold is on an AS IS, WHERE IS basis.  No warranties.  ALL SALES FINAL.

·        Forms of payment: Cash, Cashiers Check, Personal, Business Check with a letter of credit signed by an officer at your bank made out to Alaska Auction Company or Visa and Master Card.  Payment is expected in full immediately following the auction.  Cash purchases exceeding $10,000 will have the appropriate IRS from 8300 filled out and filed with the IRS.  

·        Our standard 15% buyer’s premium is in effect for this auction.

·        In the case of a dispute the auctioneer may restart the bidding.  The auctioneer will make the final decision on the winning bid.

·        This is a live out cry auction.

• All Bidders must be at least 18 years old.
• Responsibility and risk of removal shall be borne by the purchaser in every case; purchaser shall use prudence in effecting such removal.  Purchaser agrees to indemnify and save harmless both consignor and auctioneers against any damage caused by the acts of the purchaser and/or his agents in connection with any lot.
• Because of strict shipping laws and regulations we are not willing to ship or handle any chemical, medical or medical related item.  All bidders must either pick up their items in person or have an agent pick up their goods.  There are very strict laws governing shipping many of these items and the medical terms in many cases are obsolete and not readily known.  This web site may be helpful in determining more information regarding many items: www.toxnet.nlm.nih.gov
• It is critical that all bidders understand that many of the contents of items sold may become hazardous waste if and when you should decide to dispose the substances inside the containers.  If they are to be disposed of it MUST be done properly.  There are very heavy fines and ramifications if any of these items are misused or disposed of improperly.  Many can NOT be dumped in the sink or thrown out in the trash.  It Is Illegal!!!!!!!!!  You may contact Emerald Alaska Inc. 258-1558    800 East Ship Creek for disposal and proper classification.
