Properties sold at auction are sold “AS IS, WHERE IS” with no warranty by the seller. The Buyer assumes the risk that all or part of the real property will be inadequate, inappropriate or unusable for the purposes intended by the Buyer. As of the time a Buyer shall take title to the property, the Buyer will be considered to have assured him/herself that the real property is suitable for the purposes to which they intend to put it. The Buyer expressly and unequivocally assumes the risk that subsequent events or undiscovered, unknown conditions will make the real property unsuitable for those intended purposes. The Buyer acknowledges that improvements to the real property are not new, but rather are used, and the Buyer accepts the risk that there may be unknown, and even undiscoverable defects to the improvements to the real property. Earnest Money deposited by a bidder/buyer is typically a substantial amount and will be non-refundable to the successful high bidder in the event the high bidder does not complete the purchase of the auctioned property in accordance to the terms agreed to at auction. Alaska Auction Company shall not be liable to a bidder for the earnest money lost in the event of a bidder/buyer default.
